ACW-UA PRESS : One Mrs A.Magaret sue University of Abuja at the Federal High Court, LAWSAN Division.

The Federal High Court holding at the LAWSAN judicial Division today entertain a suit from one Mrs Anthony Magret, mother of late Julius Anthony who resides at No 18, sheriff street  phase3, Gwagwalada , Abuja,who sued the University of Abuja Incorporated Trustee and the Director of University of Abuja, Medical Clinic for failure on their duty of care over her son which lead to his death.
According to the MOOT fact of the case, the deceased Anthony Julius a 400 Level student of Microbiology on the 18th day of May 2019 was about to climb the pedestrian Bridge to school in the evening at about 7.15pm when he noticed that some men were following him behind, he became alarmed and started, running, knowing that if he makes use of pedestrian Bridge he had less chance of escaping his pursuers, he decided to run across the express road and in the process was hit by an incoming van. The driver rushed him to the school clinic but he was denied medical attention due to lack of Identification Card, despite his efforts to explain to the Clinical staff and authorities. Before he could take him to another hospital he gave up the ghost.
 The  Plaintiff, lead by the Learned Counsel Aminat Muhammad from Justice Chambers, sued on ground of Medical Negligence and prayed the court to award the sum of N50.000.000 to their client.

Barr. Okoro Victor Okwudili who gave an audience to ACW-UA PRESS, said " we are suing on ground of Medical Negligence, the university doctor refused to treat Julius and at such he died".

However,the Defendant counsel from Imeh Ikanem Chambers challenged the jurisdiction of the Court, arguing that the court lacks the quanti-meriti to hear this suit. A counsel to the defendant,
Hon. Sanni Adavize spoke to our news men saying "we have filed a preliminary objection seeking for the court to struck out the suit for lack of jurisdiction"
A Counsel to the Plaintiff, Miss Christiana Ene. EsQ, however expressed optimistic of winning the suit, according to her, " from the fact of the case and evidence adduced by our witnesses, we are optimistic that the court in her wisdom will rule in our Favour"

At the end of the Legal battle, the Learned Trial Judge, Nicholas L.J giving his ruling on the issue for determination  said that "it is manifestly clear that this Honourable Court, the Federal High Court of Nigeria has the jurisdiction to entertain the suit", basing his rule on University of Abuja Act106 of 1992. S1(1).
The Court however by 5.30pm adjourned the judgment of the case to the 24th of March, 2020.
